1. What Mobiulous is
Mobiulous is a software platform. Technicians are independent, state-licensed professionals who set their own prices. Reference prices are a guide only, not a quote.
Mobiulous and nailbulous.com are trade names ("doing business as", or d/b/a) of TNT Management Holding, LLC, which operates the Service ("Mobiulous", "we", "us"). We provide software that lets customers find independent beauty and wellness professionals and book times those professionals have published. The Service lists nail care, massage, eyelash services and, where offered, permanent makeup. In these terms, "technician" means any professional who offers services through Mobiulous, including nail technicians, massage therapists, eyelash artists and permanent makeup artists.
We do not perform any nail, massage, eyelash, permanent makeup or other personal-care service, we do not employ or direct technicians, and we are not a party to the agreement for a service. That agreement is between you, the customer, and the technician you book. Nothing on the Service is medical advice, and no service booked through Mobiulous is medical treatment.
Each technician runs their own business under their own name. They decide which services to offer, their prices, their hours and which bookings to accept, and they are responsible for how they do their work.
2. Accepting these terms
By creating an account, signing in, booking, applying as a technician or otherwise using Mobiulous (the "Service"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Service.
We may change these terms. For a material change we will give notice on the Service or by email before it takes effect, and the date at the top will change. If you keep using the Service after the effective date, the new terms apply to you. A change never reaches back to a booking that was already paid.
3. Who may use the Service
You must be at least 18 years old, able to form a binding contract, and in the United States. Some nail services are for children. An adult must create the account, make the booking, be present or reachable during the visit, and be responsible for the child. Children may not hold accounts. Massage, eyelash and permanent makeup services are only for customers who are 18 or older; a technician must decline such a booking for a minor.
You must give accurate information and keep it current. One person, one account. Do not share your sign-in codes.
4. Your account and sign-in
We sign you in with a one-time code sent to your email address. Anyone who can read that email can sign in as you, so protect your email account. Tell us through the Contact page at once if you think someone else used your account.
We may suspend or close an account that breaks these terms, puts anyone at risk, or is used to cheat the Service or other people.
5. How booking works
- You choose a technician and one of the times they have published. Mobiulous does not assign, endorse or rank technicians.
- When you choose a time and service, we hold it for 15 minutes while you pay. If you do not pay in that time, the hold ends and the time becomes available again.
- A booking is confirmed when your payment is recorded. Both you and the technician can then see it in their accounts.
- A technician may mark a visit as finished after it takes place. That is when any points for the booking are credited.
Technicians publish times and may withdraw a time that nobody has booked. Once a time is booked, the cancellation rules in section 7 apply.
6. Licenses, safety and where services take place
Every technician must hold, and keep current, each license, certification, registration and permit that the state, county and city where they work require for the service they offer, and must offer only services within the scope of those credentials. For example:
- Nail care: a state nail technician (manicurist) or cosmetology license.
- Massage: a state massage therapy license where the state licenses massage, and any local permit or certification the city or county requires.
- Eyelash services (extensions, lifts and tints): the cosmetology, esthetician or eyelash license or registration the state requires.
- Permanent makeup (including microblading and cosmetic tattooing): regulated in many places as tattooing or body art. It can require a practitioner registration or license, bloodborne-pathogen training, a health permit and a permitted, inspected facility, and some places do not allow it outside such a facility. A permanent makeup artist may accept a booking only for a place where the law allows the procedure.
Technicians must keep insurance where required and follow the sanitation, infection-control, safety and health rules that apply to their service, including single-use or properly sterilized tools where required. When a technician applies, we check the license details they give us against public records where a state publishes them, and a person at Mobiulous reviews each application. A check is not a guarantee of a technician's skill, conduct or compliance, and we do not supervise anyone's work.
The rules about where a service may lawfully be performed (for example a home, a workplace or a hotel) differ by service, by state and sometimes by city, and they change. Each technician is responsible for offering only services they may lawfully perform at the place they accept. We may turn off a kind of service or visits in a state or area at any time.
6A. Your health and safety
Before a service, tell your technician about anything that affects your safety, such as allergies (including to adhesives, pigments, latex, oils or fragrances), skin or eye conditions, a cut or an infection, pregnancy, diabetes, circulation or blood-clotting conditions, recent surgery, medications that affect healing or bleeding, or a medical device. Ask your doctor first if you are unsure whether a service is safe for you. A technician may ask you to complete their own health questionnaire, consent form or patch test, and may decline or stop a service for safety.
- Massage is for relaxation and general wellness. It does not diagnose or treat any medical condition and is not a substitute for medical care. You may ask the therapist to change the pressure or stop at any time. Professional draping is expected. Massage booked through Mobiulous is strictly non-sexual.
- Eyelash services work close to the eyes and use adhesives and other products that can cause irritation or an allergic reaction. Keep your eyes closed as instructed, and tell the technician at once if you feel stinging or burning.
- Permanent makeup places pigment in the skin. It is long-lasting and can be hard to remove. Risks include infection, allergic reaction, scarring, swelling, and color or shape that changes over time or differs from what you expected. Results depend on your skin and on following the artist's aftercare instructions. The artist must explain the risks and obtain your informed written consent before the procedure.
Services involve close personal contact and the use of tools and products. You accept the ordinary risks of a personal service performed with reasonable care; you do not accept the risk of a technician's negligence or misconduct. Mobiulous is not an emergency service. Call 911 in an emergency.
Everyone must treat each other with respect. Either the customer or the technician may end a visit at once if they feel unsafe or are treated inappropriately, and should then tell us through the Contact page. Harassment, sexual conduct or requests of any kind, violence, discrimination against a protected group, and unlawful conduct are not allowed; we remove anyone who engages in them and may report them to the authorities.
7. Prices, payment, cancellation and refunds
Prices. Each technician sets their own prices. The price you see before you pay is the total you pay for that booking. It includes the technician's price, any early-morning or late-evening charge the technician has set for that time (shown before you book), and any member discount you qualify for. We do not add booking fees, service fees or card surcharges at checkout. A price shown in the Services list as "Typical price" is only a reference for the market. It is not an offer, a quote or advice on what to charge, and technicians are free to charge more or less.
Payment. Payments are handled by a payment partner. Mobiulous does not see or store your full card number. Until we announce that card payments are open, payments on the Service are practice only: nothing is charged, and any booking, balance or receipt made in practice mode has no monetary value.
Cancellation. Unpaid holds end by themselves. For a paid booking, the time of the cancellation is compared with the start time of the booking:
| When | Who cancels | What happens |
|---|---|---|
| More than 24 hours before the start | Customer | Full refund to the original payment method. |
| 24 hours or less before the start | Customer | The technician keeps a late-cancellation fee: the lower of the service price and $100. The rest is refunded. The time stays reserved for you. |
| More than 24 hours before the start | Technician | Full refund. |
| 24 hours or less before the start, or the technician does not arrive within the grace period shown at booking | Technician | Full refund, plus a credit from Mobiulous toward your next booking (currently $50). |
| The technician has arrived and the customer is not there | Customer | No refund of the service price. |
We show this table before you book and in your confirmation. A refund goes back to the original payment method and never exceeds what you paid. Credits from Mobiulous apply to a later booking and have no cash value. If a service was not provided as booked, or something went wrong, use "Open a dispute" on the order in your account within the time shown there, or contact us. Nothing in these terms limits any refund or cancellation right you have under the law of your state.
8. Membership, points and rewards
Customers earn points on completed bookings and can hold a membership level. Points, levels, credits and rewards are described in the Points Terms (/points-terms), which are part of these terms. Points have no cash value, cannot be sold or transferred, and may be changed or ended as the Points Terms say.
A technician may choose whether to offer the member discount. When a technician offers it, the discount comes out of that technician's price, not from Mobiulous. If a membership ever renews automatically, we will tell you the price, the length of the term and how to cancel before you pay, and we will ask for your consent first.
9. Reviews, photos and other content
You may add reviews, photos and messages ("Content"). You are responsible for your Content. You confirm that you created it or have the right to use it, and that it does not infringe anyone's copyright, privacy or other rights, is truthful, and is lawful. You keep your rights in your Content. You give Mobiulous a worldwide, non-exclusive, royalty-free license to host, display and use it to run and improve the Service, and, for a technician's profile photo and business name, to show it to customers.
A review shown on a technician's page names you only by the first two letters of your name and your city and state, for example Sa****@Pasadena, CA. Reviews are for honest experiences. We do not remove a review because it is negative, and technicians may not ask for, pay for or threaten over reviews. We may remove Content that is unlawful, fake, abusive, or that shows another person's private information. Photos you attach to a review or a dispute are visible only to you and to Mobiulous staff reviewing the dispute.
Messages. After a booking is paid, the customer and the technician can send each other short text messages about that booking. Do not use them to harass or threaten anyone, and do not share payment card numbers. Messages are visible to the two of you, and to Mobiulous staff only when needed to answer a dispute, a support request or a legal duty; each reading by staff is logged. A conversation closes 14 days after the visit.
Customer photos are not shown to technicians, and technician photos are shown to customers. This is for safety: customers can see who is coming, and technicians cannot see a customer's picture.
10. What you may not do
- Break the law or use the Service to harm, harass, threaten, defraud or discriminate against anyone.
- Give false information, impersonate someone, or use another person's account, license or documents.
- Upload content you have no right to use, or content that is sexual, violent, hateful or that shows minors.
- Collect data from the Service with bots or scrapers, probe or attack its security, or overload it.
- Book to harm a technician or to waste their time, or post fake reviews or disputes.
- Request, offer or perform any sexual service, or any service outside the professional scope of what was booked.
- Photograph, film or record another person during a visit without their consent.
11. Technicians
Technicians on the Service are independent businesses, not employees or partners of Mobiulous. Each technician sets their own prices and hours, chooses which bookings to take, and is responsible for their own licenses, insurance, permits, taxes and the legal compliance of their services. They may offer only services within the scope of their credentials, and we may suspend a technician whose license, certification, registration or permit lapses, or who puts customers at risk.
12. Our property and copyright notices
The Service, its software, design, text and the Mobiulous name and logo belong to TNT Management Holding, LLC or its licensors. We give you a limited, revocable, non-transferable permission to use the Service as these terms allow. Maps use data from OpenStreetMap contributors and OpenFreeMap.
If you believe Content on the Service infringes your copyright, send a notice through the Contact page (topic: Copyright) that names the work, says where the material is, gives your contact details, states that you believe in good faith that the use is not authorized, and states under penalty of perjury that you are the owner or authorized to act for the owner. We remove infringing material, and we end the accounts of repeat infringers.
13. Other companies' services
The Service uses services from other companies, such as hosting, email delivery, maps and payments. Their own terms apply to what they provide. We are not responsible for them, but we choose them with care and describe the main ones in the Privacy Policy.
14. Disclaimers and limits of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, MOBIULOUS DOES NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, AND DOES NOT GUARANTEE THE QUALITY, SAFETY, LEGALITY OR TIMING OF ANY TECHNICIAN'S SERVICES, WHICH ARE PROVIDED BY THE TECHNICIAN AND NOT BY MOBIULOUS.
TO THE FULLEST EXTENT THE LAW ALLOWS, MOBIULOUS, ITS OPERATOR AND THEIR OFFICERS, EMPLOYEES AND AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, AND OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID MOBIULOUS IN THE 12 MONTHS BEFORE THE CLAIM AND $100.
Some states do not allow some of these limits, and nothing here limits liability that cannot be limited by law, including liability for fraud, willful misconduct, gross negligence or violation of law, or any right you have that the law does not let a contract take away.
You agree to defend and reimburse Mobiulous for claims, losses and reasonable costs that come from your Content, your breach of these terms, or, for a technician, your services and your violation of the law, except to the extent we caused them.
15. Resolving disagreements
Talk to us first. Use the Contact page (topic: Legal) and describe the problem. We will try to resolve it within 30 days.
Arbitration. If we cannot resolve it, you and Mobiulous agree to resolve any claim about these terms or the Service by binding arbitration on an individual basis, run by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court, except that either of us may (a) bring an individual claim in small-claims court, and (b) ask a court to stop infringement or misuse of intellectual property. The arbitrator must apply the law and these terms. We pay the filing, administrative and arbitrator fees that the AAA consumer rules require us to pay, and the hearing takes place by phone or video, or where you live. Disputes between a customer and a technician about a service are between those two people; we may help them communicate but are not a party.
No class actions. To the extent the law allows, claims may be brought only on an individual basis, and not as a plaintiff or class member in a class, collective or representative action. This does not waive any right to seek public injunctive relief that cannot be waived under the law, and it does not waive any claim brought on behalf of the State under California's Private Attorneys General Act, which may be brought in court.
You may opt out of arbitration within 30 days after you first accept these terms by sending a request through the Contact page (topic: Legal). If you do, the rest of these terms still apply.
16. Governing law
These terms are governed by the law of the State of Delaware and the United States, except that the consumer protection laws of the state where you live apply to you if they cannot be waived. Subject to section 15, courts in Delaware have jurisdiction, and you may also bring a claim in the courts of your home county if the law of your state requires it.
17. Ending your use
You may stop using the Service and ask us to close your account at any time through the Contact page. We may suspend or end your access for the reasons in section 4 or if the law requires. Closing an account does not cancel a booking that is already paid; the cancellation rules still apply. Sections that by their nature should continue (for example content, liability, and disputes) continue after your account ends.
18. The rest
Electronic communications. You agree to receive notices from us electronically, by email or on the Service, and that they satisfy any legal requirement that a notice be in writing. We send only the messages the Service needs (sign-in codes, booking and application notices, and replies to what you send). We do not send marketing text messages.
Accessibility. We want everyone to be able to use Mobiulous. If something on the Service is hard to use because of a disability, tell us through the Contact page and we will work on it.
Other terms. If a part of these terms is found unenforceable, the rest stays in force. Not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours as part of a sale or reorganization. These terms, the Privacy Policy, the Points Terms and, for technicians, the Technician Agreement are the whole agreement between you and us about the Service.
Notice for California users. Under California Civil Code section 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. In California, nail and eyelash services are regulated by the California Board of Barbering and Cosmetology; massage is regulated by cities and counties, and the California Massage Therapy Council issues voluntary state certification; permanent makeup is regulated as body art by county environmental health agencies.
Contact. Use the Contact page on this site. Please do not put sensitive details such as full payment card numbers or a Social Security number in a message.
